The jury at the St. Louis court announced its verdict against J&J last month, giving a major blow to the company as it now has to pay about $4.7 billion to 22 women or their loved-ones for the claim that it’s talc caused ovarian cancer.
The appeals court is now set as the ruling was confirmed by the trial judge recently. The company failed to question the judgment in post-trial motions and hence, Judge Rex Burlison in St. Louis announced the verdict.
Over a conference call, Alex Gorsky, CEO of J&J emphasized that his firm is “confident that our products do not contain asbestos and do not cause ovarian cancer and we intend to pursue all available appellate remedies.”
Adding to that, a J&J spokesperson commented that “every verdict against Johnson & Johnson in this court that has gone through the appeals process has been reversed and the multiple errors present in this trial were worse than those in the prior trials which have been reversed.” J&J looks to “pursue all available appellate remedies,” she said.
$550 million as compensatory reparation grant and penalty fine amounting $4.14 billion need to be shelled out by J&J, as per the July verdict.
Mark Lanier, head trial judge for the plaintiffs, commented during that time, he anticipates the verdict “will get the attention of the J&J board and that it will lead them to better inform the medical community and the public about the connection between asbestos, talc and ovarian cancer."
Latest report files reveal that 10,600 talcum powder cases are charged against J&J, in the light of this verdict.
