mHealth Application developer company Blink Health, brought legal charges against MedImpact Healthcare system, claiming the company to be a peddler of opioids. This will be the second alteration to another ongoing legal action between the two companies, which seeks a hearing by jury against MedImpact. The latest complaint lists allegations of fraud, breach of contract, and tortious interference with prospective economic relations against the company
According to the document, MedImpact, a pharmacy benefits manager (PBM), was purportedly “making profits by leading patients to generic opioids.” The document also claims MedImpact as a middle-man operates from the shadows by hoodwinking its commercial partners and illegally deriving benefits from consumers. Blink Health also alleged that MedImpact scoops off billions of dollars from acting as the middleman between manufacturers, pharmacies, payers, and patients.
Blink's accuses MedImpact of eroding and crashing the company by several misrepresentations to the company about its broker powers and relationships with pharmacies. It claims that MedImpact control pharmacies into illegitimate claw back payments and puts pressure on pharmacies to lose money sales, submitting improper claims purposely, and engaging in hidden conflicts of interest with business partners.
"We are facing twin health care crises in the growing opioid addiction epidemic and skyrocketing prescription drug prices. MedImpact plays a starring role in exacerbating these urgent problems," Orin Snyder of Gibson Dunn & Crutcher, the attorney for Blink Health, said in a statement.
Blink is now suing for money vandalizing and punitive damages, as well as a regression of the service agreement between the companies and stock purchase agreements.
